INTRODUCTION
MSHA 46.3(b)(4)] defines a competent person is the person identified by the Plant Manager who has knowledge of a topic and can effectively answer questions, train and evaluate staff IAW MSHA requirements.
MSHA’s Part 46.2(b)(4) states that a mine’s training plan must include “a list of the persons and/or organizations who will provide the training, and the subject areas in which each person and/or organization is competent to instruct.” The MSHA LMS allows you to identify the competent persons for each activity. Those competent persons will display on the Training Plan Cover Sheet.
The Person Responsible for Safety and Health listed on the Site Record automatically defaults as a competent person for each activity included in the subject by default. You will be able to add and delete one or more additional competent person(s) for each activity in all Subject Records included in the Training Program.
IDENTIFYING COMPETENT PERSONS
The first step to identifying competent person(s) for each activity in a subject is to determine if they will serve as a competent person for:
- A single site (i.e. mine)
- Multiple sites (i.e. more than one mine)
The Training Plan Cover Sheet will only list the competent persons for the organization unit in the LMS they are added to.
For example, if Fred Flintstone is added to the LMS on a team located in the Camas Site and is identified as a competent person on the subject record; he will only appear on the Training Plan Cover Sheet as a competent person for the Camas Site (his primary work site). If he also serves as a competent person at the Portland Site, follow the additional step of Associating Competent Person(s) to Multiple Sites.
All competent persons, regardless of their primary worksiste, must be identified in the Subject Record. Follow the steps to Add a Competent Person below.
ADD A COMPETENT PERSON
All competent persons, must be identified in the Subject Record for each activity they are a competent person for regardless if they will be a competent person for one or more sites.
Follow these steps to Add a Competent Person below:
- Click the Administration tab at the top of the screen
- Click the Training Programs link, then Subjects on the left menu bar
- Click the Edit button to the left of the subject name
- Scroll down to the Competent Persons listbox of the MSHA fields section
Note: The system defaults the Person Responsible for Safety and Health entered on the Site record as the Competent Person. Follow the steps to Delete a Competent Person if they are not considered a competent person for the activity. - Click the Add Competent Person button. The Create Competent Person screen appears.
- Click the Select button to the right of the Activity list box
- A list of all the activities included in the subject will appear in the Available Records table
- Select the checkboxes to the left of each activity the person(s) will be a competent person for
- Click the right arrow to add the selected activities to the Selected Records table
- Click the Select button
- Click the Select button the right of the Competent Person checkbox
- A list of all users will appear in the Available Records table
- Select the checkboxes to the left of each user that willl be named a competent person
- Click the right arrow to add the selected users to the Selected Records table
- Click the Select button
- Check the Is Primary checkbox
Note: The Is Primary indicates which user is the Primary Competent Person for the activity. There must be one primary for each activity in a subject. - Click the Save button
- You will be returned to the Edit Subject screen
- Repeat these steps until you have added all the competent persons for each activity in the subject. Once you have added all the competent persons for each activity:
- Click the Save button.
- Click the Close button after the Changes Saved confirmation appears
- Repeat these steps for each Subject included in the Training Program
- Please refer to the Associating Competent Person(s) to Multiple Sites if the Competent Persons added will be serving as a Competent Person for multiple sites (i.e. mines) for your company. This will allow you to identify the sites they will be a Competent Person for.
EDIT A COMPETENT PERSON
Edit a competent person to:
- Add the activit(ies) a user is a competent person for
- Delete the activit(ies) a user is a competent person for
- Add or Remove the Is Primary status.
Follow these steps to Edit a Competent Person below:
- Click the Administration tab at the top of the screen
- Click the Training Programs link, then Subjects on the left menu bar
- Click the Edit button to the left of the subject name
- Scroll down to the Competent Persons listbox of the MSHA fields section
Note: The system defaults the Person Responsible for Safety and Health entered on the Site record as the Competent Person. Follow the steps to Delete a Competent Person if they are not considered a competent person for the activity. - Click the Edit button. The Edit Competent Person screen appears.
To Add Activities
- Click the Select button to the right of the Activity list box
- A list of all the activities included in the subject will appear in the Available Records table
- Select the checkboxes to the left of each activity the person will be a competent person for
- Click the right arrow to add the selected activities to the Selected Records table
- Click the Select button
- Click the Save button
- You will be returned to the Edit Subject screen
- Click the Save button.
- Click the Close button after the Changes Saved confirmation appears
To Remove Activities
- Click the Select button to the right of the Activity list box
- A list of all the activities previously selected will appear in the Selected Records table (right side of screen)
- Select the checkboxes to the left of each activity in the Selected Records table the user is not considered a Competent Person for
- Click the left arrow to remove the activities from the Selected Records table
- Click the Select button
- Click the Save button
- You will be returned to the Edit Subject screen
- Click the Save button.
- Click the Close button after the Changes Saved confirmation appears
To Remove or Add "Is Primary"
- Check or uncheck the Is Primary checkbox
Note: The Is Primary indicates which user is the Primary Competent Person for the activity. There must be one primary for each activity in a subject. - Click the Save button
- You will be returned to the Edit Subject screen
- Click the Save button.
- Click the Close button after the Changes Saved confirmation appears
DELETE A COMPETENT PERSON
The LMS allows you to delete the Competent Person from the associated activity. For example, the system defaults the Person Responsible for Safety and Health as a Competent Person for all activities in all subjects. You can delete them as a Competent Person.
Follow these steps to delete a competent person:
- Click the Administration tab at the top of the screen
- Click the Training Programs link, then Subjects on the left menu bar
- Click the Edit button to the left of the subject name
- Scroll down to the Competent Persons listbox of the MSHA fields section
- The Subjects section displays all Competent Persons by Activity
- Click the Delete button.
- Click YES on the Delete Competent Person confirmation screen
- Click OK on the Delete Competent Person confirmation screen
- Scroll down tot he Competent Person section and the competent person will no longer appear in the list
- Click the Save button
- Click the Close button after the Changes Saved confirmation appears
Delete Competent Person Warning
You will receive the following warning under two circumstances:
- There is only one Competent Person for the activity
- There are mutliple Competent Persons for the activity and you are deleting the Primary Competent Person
Before you can proceed you must either:
- Add a Competent Person for the activity before you can delete the Competent Person. Please refer to the Add a Competent Person section of this article to add a Competent Person.
- Identify one of the Competent Persons as the Primary Competent Person before deleting the only Primary Competent Person. Please refer to the Edit a Competent Person section of this article to identify the primary competent person.
ASSOCIATING COMPETENT PERSON(S) TO MULTIPLE SITES
When one or more users are serving as a Competent Person for multiple sites (i.e. mines), the LMS will allow you to assoicate which sites they are a Competent Person for by updating the User Record.
This article will address how to add and remove multiple sites from a user record.
Add Multiples Sites
Follow these steps to associate the sites to the User Record:
- Click the Administration tab at the top of the screen
- Click the Organization link, then Users on the left menu bar
- Search and locate the desired user
- Click the Edit button to the left of the users' name
- Scroll down to the Attributes section
- Click the down arrow on the right side of the Attributes drop down list
- Check the Competent for Site checkbox
- Click the Add button
- The Competent for Site list box will appear
- Click the Select button to the right of the list box
- A list of all the sites will appear on the right side of the Available Records table
- Select the checkboxes to the left of each site the user will be a Competent Person for
- Click the right arrow to add the sites to the Selected Records table
- Click the Select button
- You will be returned to the Edit User screen. The Competent for Site list box will display your selections
- Click the Save button
- Click the Close button after the Changes Saved confirmation appears
Remove Multiples Sites
Follow these steps to remove the associatioin of the sites to the User Record:
- Click the Administration tab at the top of the screen
- Click the Organization link, then Users on the left menu bar
- Search and locate the desired user
- Click the Edit button to the left of the users' name
- Scroll down to the Attributes section
- The Competent for Site list box displays the sites that are currently associated
- Click the Select button to the right of the list box
- A list of all the sites previously selected will appear in the Selected Records table (right side of screen)
- Select the checkboxes to the left of each site in the Selected Records table the user will no longer be a competent user for
- Click the left arrow to remove the activities from the Selected Records table
- Click the Select button
- You will be returned to the Edit User screen. The Competent for Site list box will display your new selections
- Click the Save button
- Click the Close button after the Changes Saved confirmation appears
